MisterLink Terms of Service

1. Acceptance of Terms

Welcome to MisterLink. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use MisterLink.

These Terms constitute a legally binding agreement between you and MisterLink. We may update these Terms from time to time, and your continued use of the platform constitutes acceptance of any changes.

2. Description of Service

MisterLink is a platform that connects sports coaches with sports clubs in Switzerland. The service includes:

• Profile creation for coaches and clubs
• Job posting creation and management (for clubs)
• Job search and browsing (for coaches)
• Application submission and management
• Coach profile browsing (for clubs)
• Communication features between coaches and clubs

MisterLink is a platform only. We facilitate connections between coaches and clubs but are not responsible for the outcome of any employment relationships, contracts, or disputes that arise from use of the platform.

3. User Eligibility

To use MisterLink, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and truthful information
• Comply with all applicable laws and regulations

By registering, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Account Registration

You must create an account to use MisterLink. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Types

• Coach Accounts: For individual sports coaches seeking employment or opportunities
• Club Accounts: For sports clubs and organizations seeking to hire coaches

You may only create one account per email address. Creating multiple accounts to circumvent restrictions or manipulate the platform is prohibited.

4.3 Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms or engage in prohibited conduct.

5. User Responsibilities and Conduct

5.1 Accurate Information

You agree to provide accurate and truthful information in your profile, job postings, and applications. Misrepresentation of qualifications, experience, or credentials is strictly prohibited.

5.2 Prohibited Conduct

You may NOT:

• Post false, misleading, or fraudulent information
• Impersonate another person or entity
• Harass, abuse, threaten, or discriminate against other users
• Use the platform for any illegal purposes
• Spam, solicit, or send unsolicited communications
• Scrape, crawl, or harvest data from the platform
• Attempt to gain unauthorized access to the platform or other users' accounts
• Upload viruses, malware, or malicious code
• Use the platform to advertise unrelated products or services
• Circumvent any security features or access controls
• Use automated tools (bots) to interact with the platform

5.3 Professional Conduct

All users must conduct themselves professionally and respectfully. Discrimination based on age, gender, race, religion, nationality, disability, or any other protected characteristic is strictly prohibited.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of the content you post on MisterLink (profile information, photos, CV, job postings, etc.). By posting content, you grant MisterLink a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to operate the platform.

6.2 Content Standards

All content must:

• Be accurate and truthful
• Not violate any laws or regulations
• Not infringe on third-party intellectual property rights
• Not contain offensive, discriminatory, or inappropriate material
• Be relevant to coaching and sports employment

6.3 MisterLink's Intellectual Property

The MisterLink name, logo, design, and all platform features are the intellectual property of MisterLink. You may not use, copy, or reproduce any of our intellectual property without prior written permission.

6.4 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise inappropriate, without prior notice.

7. Job Postings and Applications

7.1 For Clubs

Clubs may post job openings for coaching positions. All job postings must:

• Be for legitimate coaching positions
• Contain accurate information about the position, requirements, and compensation
• Comply with Swiss employment laws
• Not discriminate against protected classes

7.2 For Coaches

Coaches may apply to job postings through the platform. Applications should be professional, accurate, and relevant to the position.

7.3 No Employment Guarantee

MisterLink does NOT guarantee employment, job placement, or successful matches. We are a platform that facilitates connections only.

7.4 Employment Relationships

Any employment relationship formed through MisterLink is between the coach and the club. MisterLink is not a party to any employment contract and has no liability for disputes, non-payment, termination, or any other employment-related issues.

8. Fees and Payment

MisterLink is currently free to use for both coaches and clubs. We reserve the right to introduce fees or premium features in the future. If we do, we will provide advance notice and update these Terms accordingly.

9. Privacy and Data Protection

Your use of MisterLink is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the platform, you consent to the practices described in the Privacy Policy.

10. Disclaimers and Limitations of Liability

10.1 "As Is" Service

MisterLink is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be:

• Uninterrupted, secure, or error-free
• Free from viruses or harmful components
• Accurate, reliable, or complete

10.2 No Verification

We do not verify the accuracy of user profiles, qualifications, certifications, or job postings. Users are responsible for conducting their own due diligence before entering into any employment relationship.

10.3 Limitation of Liability

To the maximum extent permitted by law, MisterLink and its affiliates, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from use or inability to use the platform
• Damages arising from user content or conduct
• Damages arising from employment relationships formed through the platform

Our total liability shall not exceed CHF 100 or the amount you paid to MisterLink (if any), whichever is greater.

10.4 Third-Party Services

MisterLink may integrate with third-party services (e.g., authentication providers, storage providers). We are not responsible for the availability, accuracy, or content of third-party services.

11. Indemnification

You agree to indemnify, defend, and hold harmless MisterLink from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Your content posted on the platform

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or use of MisterLink shall be resolved through:

1. Informal Resolution: Contact us at info@misterlink.ch to attempt to resolve the issue informally.
2. Mediation: If informal resolution fails, parties agree to attempt mediation.
3. Jurisdiction: If mediation fails, disputes shall be resolved in the competent courts of Switzerland.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the app. Material changes will be communicated via:

• In-app notification
• Email notification (if you have provided an email address)
• Updated "Last Updated" date on this page

Your continued use of MisterLink after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the platform and delete your account.

14. Termination

14.1 Termination by You

You may terminate your account at any time through the app settings. Upon termination, your profile and data will be deleted in accordance with our Privacy Policy.

14.2 Termination by MisterLink

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in prohibited conduct
• Pose a security or legal risk
• Provide false or misleading information

14.3 Effect of Termination

Upon termination:

• Your right to use the platform ceases immediately
• Your profile and content may be removed
• Outstanding obligations (e.g., indemnification) remain in effect

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MisterLink.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Language

These Terms are provided in English, German, French, and Italian. In case of discrepancies, the English version prevails.
